This Privacy Notice applies to the websites, applications and platforms where it appears, as well as any other points of contact with Tyson Foods.
Maintaining the security of your data is a priority for Tyson Foods, Inc. and its subsidiaries, affiliates and related entities (collectively, "Tyson Foods," "we" or "us"). Tyson Foods is committed to being transparent about what data we collect about you and how we use it. This Privacy Notice applies to all users of our websites, applications, platforms and features (collectively, "Site(s)"), as well as all communication with us or participation in any of our programs or events. We may provide additional privacy notices in connection with certain activities, programs or offerings. This Privacy Notice applies to Tyson Foods’s information practices for you to understand how personal data is collected through our Sites and how it is used, stored and disclosed. This Privacy Notice also describes your rights regarding the personal data we hold about you, including how you can exercise those rights.
We are committed to protecting the privacy of minors. To comply with various privacy regulations, at this time our Sites are not intended to be used by anyone under the age of 18 and are not designed to attract children under the age of 18. Anyone under the age of 18 using our Sites should only do so with participation of a parent or other guardian. If a parent or other guardian becomes aware that his or her child has provided us with information without their consent, the parent or other guardian should contact us at privacy@tyson.com. Tyson Foods will delete such information within a reasonable time.

Under certain privacy laws, the “Controller” or “Personal Information Processor” of your data is Tyson Foods, Inc. We will only process your personal data according to this Privacy Notice, unless otherwise required by applicable law. We take steps to ensure that the personal data that we collect about you is adequate, relevant, not excessive, and processed for limited purposes.
Personal data is information that identifies, relates to, describes, is reasonably capable of being associated with or could reasonably be linked, directly or indirectly, to an identified or identifiable living natural person or household. Tyson Foods only processes your personal data as the law allows or requires or according to this Privacy Notice.
We may collect the following categories of personal information that you provide directly when you use our Sites, or otherwise participate in our programs or events. (Please note, not all categories may be collected on every individual):

Where we request personal information and Sensitive Data from you, you can choose not to provide it to us. However, unless otherwise indicated, the information we request from you may be required to enter into a contract of purchase with you or in order to comply with our legal obligations. Failure to provide it may prevent us from effectively administering our contractual relationship with you and/or complying with our legal obligations, which may mean we are unable to continue your order, purchase, or other engagement.

In compliance with applicable law, Tyson Foods may use artificial intelligence (AI) to assist in our processing of information for the purposes described above and may offer products, services and offerings through tools and platforms using AI.
Profiling
As part of certain promotions located within the United States, we may collect personal data about you (i.e. location data, product interest, preferences and other information) that you provide us when you create an account on our platforms. This section only applies when we use automated processing on your personal information to evaluate, analyze, or predict your personal preferences. We centralize this data and analyze it to evaluate and predict your personal preferences and/or interests. Based on our analysis, we send communications and/or content (i.e. digital advertising) tailored to your preferences.
When we send personalized communications or content, we may use some techniques qualified as “profiling” (i.e. any form of automated processing of personal data consisting of using those data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s personal preferences, interests, economic situation, behavior, location, health, reliability, or movements).
You may have the right to access and obtain communication about the decision based on this profiling, including the logic involved and the consequences. You can update and delete your information through your platform account at any time. You also have the right to object to the use of your data for “profiling” in certain circumstances. Depending on your residency, these rights may not apply to pseudonymous data if the information necessary to identify the consumer is kept separately and is subject to controls that prevent access to the information. Pseudonymous data is personal information that can no longer be attributed to a specific individual without the use of additional information, if the additional information is kept separately and is subject measures to ensure that personal information is not attributed to the specific individual. section below.
Data solely retained for data backup or archive purposes is principally excluded from these rights until it is restored to an active system or next accessed or used for a sale, disclosure, or commercial purpose.
Generally, we collect any information you or a member of your household voluntarily share with us directly, through technology on Tyson Foods-owned property or administered on Tyson Foods’s behalf, but we may also collect data from other sources. For example, we may collect the following:

As we are a global company, your personal data may be processed by Tyson Foods, its affiliates, and other third parties described herein in countries other than the country of which you are a resident. Personal data may be sent to countries with different privacy laws than the country of your residence. Because the law in some of these countries does not provide the same level of protection, we implement appropriate safeguards and take measures to ensure adequate mechanisms are in place to protect your personal data in accordance with applicable data protection and privacy laws. We have data transfer agreements in place, which are considered appropriate safeguards implementing approved Standard Contractual Clauses to secure the transfer of your personal data to other jurisdictions. We have implemented appropriate physical, technical, and organizational security measures designed to secure your personal data against accidental loss and unauthorized access, use, alteration, or disclosure. Subject to certain limitations under certain United States state privacy laws and in addition to the disclosures and rights provided in this Privacy Notice, those state residents may request under applicable law:

Consumer Health Data Privacy
Residents of Washington and Nevada have certain rights related to ‘consumer health data’ collected in those respective states. This section uses certain terms that have the meaning given to them in Nevada S.B. 370 and/or the Washington My Health My Data Act.
We may collect the following categories of consumer health data about you: reactions, allergies, conditions or diagnoses, medications, treatments or tests. We may collect consumer health data from you, such as when you complete product reviews. When required by applicable law, we will obtain your consent to collect and use your consumer health data.
We may use consumer health data for the following purposes: recommending products to you; obtaining feedback from you; investigating your concerns; analyzing the cause of your concern; evaluating and improving the safety of our products; communicating with you about the use of our products (including through newsletters, emails and the use of our AI tools that assist our operations); understanding how users access and use our products and offerings and for other research and analytical purposes; tailoring the content that we may send you to personalize your experience; sending you any other information that you sign up to receive; improving our advertising campaigns to better reach individuals with relevant content; complying with legal obligations and internal and regulatory reporting or audit requirements; or securing and supporting our general business operations.

We may share consumer health data described herein with other members of our group of companies; employees, officers and contractors; third party service providers, suppliers or subcontractors or their representatives authorized on their behalf whose services are directly related to the processing of such information; government agencies, authorities, regulators and law enforcement authorized to request personal data for lawful purposes or as otherwise required by law. Residents of Washington and Nevada also have a right to receive a list of third parties and affiliates (and contact information) with whom we shared or ‘sold’ consumer health data.
Notice of Financial Incentives/Bona Fide Loyalty Program Disclosure
We may offer incentives, such as a coupon or discount on purchase in exchange for personal information (e.g. email sign-up). We may also offer a loyalty program that will provide certain perks, such as rewards and exclusive offers, as well as other programs like sweepstakes or contests. Each of those incentives or programs may be considered a ‘financial incentive’ or a ‘bona fide loyalty program’ under one or more U.S. state privacy laws. Through participating in these programs, you may provide us with any of the categories of information set forth in this Privacy Notice.
We generally do not assign monetary or other value to personal information. If, however, we are required by law to assign such value, we have valued the personal information collected and used as based, in part, on the value of consumer trial of new products and sharing future offers tailored to your interest with competitive value. The value is a practical and good-faith effort often involving (i) the categories of personal information collected (e.g., names, email addresses), (ii) the transferability of such personal information for us, (iii) the discounted price offered, (iv) the volume of consumers enrolled in our programs, and (v) the product or service to which the programs, or price or service differences, applies. The disclosure of the value described herein is not intended to waive, nor should be interpreted as a waiver of, our proprietary or business confidential information, including trade secrets, and does not constitute any representation with regard to generally accepted accounting principles or financial accounting standards.
Participation in any program is voluntary, and by signing up for one, you consent to the collection, use, and disclosure of personal information about you in connection with a program. If you later wish to withdraw your consent, you can do so by contacting us, or otherwise following the instructions set forth in a specific program’s terms and conditions, if applicable.
Please note that if you choose to opt-out of the sale or sharing of personal information about you, or the use of personal information about you for targeted advertising (where available under U.S. state privacy law), your participation in a program will not be affected and you will continue to receive all the benefits to which you are entitled. Certain jurisdictions permit a consumer to designate an Authorized Agent to submit a disclosure or deletion request on behalf of the individual. To respond to a request from an Authorized Agent, we may:
- Request a copy of the written permission, such as a power of attorney or registration with the applicable government agency, granting the Authorized Agent to make such a request on the individual’s behalf; and
- Verify the identity of the individual as described below.
Authorized agents use the same links described above to submit requests. Tyson Foods may deny a request from an Authorized Agent that does not submit proof that they have been authorized by an individual to act on their behalf.
We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the personal data that we hold about you or make your requested changes. To verify your identity, we will generally match the identifying information provided in your request with the information we have on file about you. Depending on the sensitivity of the personal information requested, we may also utilize more stringent verification methods to verify your identity. We may ask you to provide other documentation to verify your identity. If this happens, we will reach out to you directly with this request. We may not be able to comply with your request if we are unable to confirm your identity or connect the information you submit in your request with personal information in our possession.
Applicable law may allow or require us to refuse to provide you with access to some, or all, of the personal data that we hold about you, or we may have destroyed, erased, or made your personal data anonymous in accordance with our data retention obligations and practices. If we cannot provide you with access to your personal data, we will inform you of the reasons why, subject to any legal or regulatory restrictions. If you choose to exercise your rights, we will respond as required by law.
